Hearing Loss Compensation

One of the major factors which are responsible for causing hearing loss among people is Industrial deafness. The fact is evident from the growing number of legal claims by the workers who have suffered. The hearing loss claim process is so easy that some legal organizations are promoting themselves with a campaign 'No win, no fees'.

How Much is my Hearing Loss Claim Worth?

Industrial deafness can again be classified as partial and permanent.
Partial hearing loss includes tinnitus along with hearing loss.
  • For hearing loss with occasional tinnitus, the claim can be from £4,000 to £8,000.
  • When there is more serious tinnitus the claim can be from £8,000 to £20,000.
  • When the tinnitus is severe the claims can be from £20,000 to £29,000.
Total hearing loss can again be further classified as that in one year or in both years. For one year it could be up to £30,000 and for both years it could be up to £70,000 depending upon the severity of the injury. However to receive the proper compensation it is important that people contact the hearing loss claim specialist, as soon as possible.

Claims for compensation can be made up within 3 years from the time the hearing loss has become noticeable, as per the limitation imposed by the Limitation Act 1980. So, one must act quickly when claiming for the compensation. As this is a very short period to claim, RNID has been campaigning for revising this period to 5 years. Their efforts have been a bit fruitful and a body has been setup to revise the threshold levels in the working area.

People working in places where the noise levels beyond the safety standards are more likely to be exposed to the Industrial deafness. People working with jet engines, sheet metal industry, construction industry, and people dealing with musical instruments, telephone operators are few examples of those who could become victims for the hearing loss. A dog's bark can prove out to be more dangerous than its bite. We often tend to ignore the bark but if a dog is barking more occasionally and the noise level is irritating, then it should be considered as serious factor.

What is being done by Employers?

Measures are being taken in work areas to reduce the effects of noise. If you cannot hear your co-worker from a distance of 2 meters, then it should be considered that the noise level is beyond the safety thresholds and should be considered seriously. Ear plugs or ear muffs should be provided to workers to protect themselves. However, once these safety aids are provided and the worker is not wearing them the employer will not be responsible for making any compensation.

Usually it is not the employer, but the insurance companies (of course through the employer) who will be providing the compensation for the hearing losses. Also remember that there is no compensation for self-inflicted losses from hearing musing at high volume levels. Follow the instructions provided by the manufacturers of audio devices and accessories.

Ultimately it is the sole responsibility of every person to take care of themselves and provide safe working environment to prevent the loss. Any breach or damage levels should be immediately reported and corrective measures should be taken. The huge amount of compensation can never make justification for the loss of the natural gift of hearing.

Hearing aids can help with some forms of hearing loss and should be investigated further if you want to help improve your hearing.
